Terms of Use

By using our Services, you are agreeing to these terms. Please read them carefully.

1. Introduction

1. These Terms and Conditions apply to the use of Interweave Patient Engagement Portal (Interweave PEP) (as defined below). By using the Interweave PEP, you agree to the Terms and Conditions and enter into an agreement with Interweave (“Agreement”). If you do not wish to agree to the Terms and Conditions, you cannot use the Interweave PEP.
2. Interweave is the brand name of a shared care record solution owned by six Integrated Care Systems via the Interweave partners.

2. Terms

1. The Interweave PEP enables healthcare providers to provide technology that supports patient communications, appointment management and remote care and allows patients to manage their care in a digital-first fashion.
2. By accessing the Interweave PEP via the NHS App you are agreeing to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Interweave PEP. The materials contained in the Interweave PEP are protected by applicable copyright and trade mark law.

3. Licence and Acceptable Use

Subject to your full and continued compliance with all obligations pursuant to these Terms and Conditions, Interweave grants you a limited, personal, revocable, non-exclusive, non-sub-licensable and non-transferable right to use the Patient Platform for personal, non-commercial, transitory purposes. This is the grant of a licence, not a transfer of title, and under this licence you may not:

1. modify or copy any information, data or materials available on the Interweave PEP (“Content”);
2. use Content for any commercial purpose, or for any public display (commercial or non-commercial);
3. transfer Content to third parties without a lawful basis (for example a Court Order);
4. break the law or encourage any unlawful activity;
5. send or upload anything that is (or might be considered to be) defamatory, offensive, obscene or discriminatory;
6. infringe our or anyone else’s intellectual property rights (for example, by using or uploading someone else’s content, remove any copyright or other proprietary notations);
7. attempt to decompile or reverse engineer any software contained on the Patient Platform;
8. transmit any harmful software code such as viruses;
9. try to gain unauthorised access to computers, data, systems, accounts or networks; or
10. deliberately disrupt the operation of anyone’s website, app, server or business.

4. Payment

If you are a patient, there are no fees payable to Interweave for using the PEP.

5. Suspension/Termination of Use

1. Your access to the Interweave PEP will cease upon your healthcare provider’s access to the Interweave PEP ceasing.
2. If you breach your obligations under the Agreement and/or the Terms and Conditions, Interweave has the right to immediately discontinue or to (temporarily) suspend your access to the Interweave PEP, revoke your licence or terminate the Agreement, notwithstanding its other rights and remedies.
3. You are able to terminate your use of the Interweave PEP by no longer using the service. It is your responsibility to remove any saved login details from your device if you wish to terminate your use of the Interweave PEP, or if you change your device or otherwise dispose of it.
4. You can opt-out of your personal data being processed by the Interweave PEP by contacting your healthcare organisation or Interweave, More details can be found in Interweave’s Privacy Notice.

6. Liability

1. To the fullest extent permitted by law, Interweave’s liability under any guarantee, condition or warranty or any other right or remedy, is hereby excluded.
2. In no event shall Interweave or its suppliers be liable for any damages howsoever caused (including, without limitation, direct and indirect loss and damage, damages for loss of data or profit, or due to business interruption,) arising out of
   1. your access to, use or inability to use the PEP, the Content or any linked site;
   2. any decision or action taken by you in reliance on the PEP, the Content or any linked site.
   3. any error or defect in the PEP;
   4. any contravention by any other user of any applicable laws.
3. Any liability for defected Content remains the responsibility of the organisation who uploaded the Content to their electronic patient record.

7. Warranties

1. The Interweave PEP and the Content are provided “AS IS” and “AS AVAILABLE”. Each and every use of the PEP is at your own risk and responsibility. Interweave does not warrant that use of the PEP will be uninterrupted or error-free and Interweave does not accept responsibility for any part of the service provision infrastructure (including without limitation the internet) which is outside its reasonable control.
2. Interweave makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
3. Further, Interweave does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of Content or otherwise relating to such content. Interweave reserves the right, without prior notice, to abridge, alter, refuse and/or remove access to Content in its absolute discretion.

8. Modifications to Terms and Conditions

Interweave may revise these Terms and Conditions at any time without notice. By using the PEP you are agreeing to be bound by the then current version of these Terms and Conditions. If you do not agree to the amended or supplemented Terms and Conditions, your only option is to stop using the PEP and terminate the Agreement in accordance with Section 5 of this Agreement.

9. Governing Law

Any claim relating to the Interweave PEP, the Content or these Terms and Coonditions, your only option is to stop using the PEP and terminate the Agreement in accordance with Section 5 of this Agreement.

10. Governing Law

Any claim relating to the Interweave PEP, the Content or these Terms and Conditions shall be governed by the laws of England and Wales.
